Inmate settles civil rights lawsuit with Pa. CO

Inmate claimed CO forced him to return to cell where two inmates who attacked him before assaulted him again

BUTLER COUNTY, Pa. — A Pennsylvania inmate has settled a lawsuit against a CO, claiming that the officer violated his civil rights.

According to Trib Live, Dameine Austin says that Corrections Officer Ryan McCandless forced him to return to a jail cell where two state prisoners who had just attacked him assaulted him again.

Originally, the suit was against the county, Butler County Prison, the prison’s board, Wardn Gigliotti, several COs and a nurse. Judge Maureen Kelly dismissed his claims against everyone except CO McCandless.

Kelly on Thursday approved a motion by Austin’s attorney to dismiss the case. County solicitor Mike English confirmed there is a settlement but gave no details.
