LIMA, Ohio — An Ohio attorney says he’ll appeal his client’s murder conviction because jurors saw a video of the suspect fighting with another inmate who was about to testify against him.
Authorities say a guard mistakenly put the two together in a holding cell. Jailers broke up the altercation within two minutes, and the men suffered only minor injuries.
A judge allowed video of the fight to be shown to the jury despite objections from a defense attorney.
On Tuesday, the jurors convicted Markelus Carter of aggravated murder. He was sentenced to life in prison without parole but maintained he is innocent.
Carter’s attorney, Jon Paul Rion, tells The Lima News that the fight video had a big effect and changed how jurors looked at the evidence.
